A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the applicability of the law governing innovative |
|
|
programs for environmental regulation administered by the Texas |
|
|
Commission on Environmental Quality. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 5.751, Water Code, is amended to read as |
|
|
follows: |
|
|
Sec. 5.751. APPLICABILITY. This subchapter applies to |
|
|
programs under the jurisdiction of the commission under Chapters |
|
|
26, 27, and 32 of this code and Chapters 361, 375, 382, and 401, |
|
|
Health and Safety Code. It does not apply to: |
|
|
(1) occupational licensing programs under the |
|
|
jurisdiction of the commission; or |
|
|
(2) a program for the permitting of desalination |
|
|
facilities, including facilities that use reverse osmosis, |
|
|
nanofiltration, or electrodialysis reversal. |
|
|
SECTION 2. This Act takes effect September 1, 2013. |
