A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of the Texas Commission on Environmental |
|
|
Quality to create a groundwater conservation district in certain |
|
|
counties. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 36.0151(f), Water Code, is amended to |
|
|
read as follows: |
|
|
(f) The [Before September 1, 2015, the] commission may not |
|
|
create a groundwater conservation district under this section in a |
|
|
county: |
|
|
(1) in which the annual amount of surface water used is |
|
|
more than 50 times the annual amount of groundwater produced; |
|
|
(2) that is located in a priority groundwater |
|
|
management area; and |
|
|
(3) that has a population greater than 2.3 million. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
