A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the required completion date of a report concerning an |
|
|
initial evaluation of a student for purposes of special education |
|
|
services. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subsection (a), Section 29.004, Education Code, |
|
|
is amended to read as follows: |
|
|
(a) A written report of a full individual and initial |
|
|
evaluation of a student for purposes of special education services |
|
|
shall be completed not later than the 60th school [calendar] day |
|
|
following the date on which the school district, in accordance with |
|
|
20 U.S.C. Section 1414(a), as amended, receives written consent for |
|
|
the evaluation, signed by the student's parent or legal guardian. |
|
|
SECTION 2. This Act applies beginning with the 2013-2014 |
|
|
school year. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
