A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to evaluating the adequacy of education provided to |
|
children in county jails. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 25, Education Code, is |
|
amended by adding Section 25.00112 to read as follows: |
|
Sec. 25.00112. ADEQUACY OF EDUCATION PROVIDED TO CERTAIN |
|
CHILDREN IN COUNTY JAILS. (a) This section applies to a child who |
|
is under 18 years of age who is confined to a county jail. |
|
(b) The agency shall evaluate the adequacy of educational |
|
services provided to children described by Subsection (a) |
|
throughout the state. |
|
(c) If the agency finds that the educational services |
|
provided to children described by Subsection (a) are insufficient, |
|
the commissioner shall adopt rules requiring each school district |
|
in which a county jail is located to take actions and provide |
|
services to address any deficiencies. |
|
(d) The agency shall submit a report on its findings under |
|
this section and, if applicable, any rules adopted or other actions |
|
taken by the agency to the legislature not later than January 1 of |
|
each odd-numbered year. The report may include legislative |
|
recommendations. |
|
(e) This section expires September 1, 2017. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2013. |
