AN ACT
|
|
relating to circumstances under which a vacancy on the governing |
|
body occurs in certain municipalities. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 22.041, Local Government Code, is |
|
amended by adding Subsection (c) to read as follows: |
|
(c) In addition to an absence described by Subsection (b), a |
|
member of a governing body is also considered absent for the |
|
purposes of that subsection if the member is not present at the |
|
adjournment of a meeting at which a quorum is established, unless |
|
the member is first allowed to withdraw by the unanimous vote of the |
|
members present. This subsection applies only to a municipality |
|
that is located in a county with a population of 800,000 or more |
|
that is adjacent to an international border. |
|
SECTION 2. The change in law made by this Act applies only |
|
to a meeting held on or after the effective date of this Act. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2013. |
