A BILL TO BE ENTITLED
 
AN ACT
  relating to the regulation of certain pits used to store flowback or
  produced water from an oil or gas well on which a hydraulic
  fracturing treatment has been performed.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 91, Natural Resources
  Code, is amended by adding Section 91.1017 to read as follows:
         Sec. 91.1017.  PITS USED TO STORE FLUID FROM HYDRAULICALLY
  FRACTURED WELLS. (a) This section applies only to a pit that:
               (1)  is located at the site of an oil or gas well on
  which a hydraulic fracturing treatment has been performed; and
               (2)  is used to store flowback and produced water from
  the well.
         (b)  A pit is not required to be lined if the fluid stored in
  the pit is of a quality that meets or exceeds the quality of the
  water that was used in the hydraulic fracturing treatment.
         SECTION 2.  This Act takes effect September 1, 2013.
