A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the regulation of certain pits used to store flowback or |
|
|
produced water from an oil or gas well on which a hydraulic |
|
|
fracturing treatment has been performed. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter D, Chapter 91, Natural Resources |
|
|
Code, is amended by adding Section 91.1017 to read as follows: |
|
|
Sec. 91.1017. PITS USED TO STORE FLUID FROM HYDRAULICALLY |
|
|
FRACTURED WELLS. (a) This section applies only to a pit that: |
|
|
(1) is located at the site of an oil or gas well on |
|
|
which a hydraulic fracturing treatment has been performed; and |
|
|
(2) is used to store flowback and produced water from |
|
|
the well. |
|
|
(b) A pit is not required to be lined if the fluid stored in |
|
|
the pit is of a quality that meets or exceeds the quality of the |
|
|
water that was used in the hydraulic fracturing treatment. |
|
|
SECTION 2. This Act takes effect September 1, 2013. |
