A BILL TO BE ENTITLED
 
AN ACT
  relating to increasing the recreational sports fee at Texas State
  University System institutions.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Sections 54.538(a) and (b), Education Code, are
  amended to read as follows:
         (a)  If approved by student vote at a system institution, the
  Board of Regents, Texas State University System, may charge each
  student enrolled at such institution a recreational sports fee not
  to exceed $200 [$100] per semester or summer session of 10 weeks or
  longer or $100 [$50] per summer session of less than 10 weeks. The
  fee may be used to purchase equipment for and to construct, operate,
  and maintain recreational sports facilities and programs at the
  designated institution.
         (b)  The board may increase the recreation fee authorized by
  this section as it considers necessary to operate, maintain,
  improve, and equip recreational sports facilities.  The recreation
  fee may not be increased more than 10 percent from one academic year
  to the next unless the increase has been approved by a majority vote
  of those students at the affected institution participating in a
  general student election called for that purpose. The fee may not
  exceed the amounts provided by Subsection (a).
         SECTION 2.  The change in law made by this Act applies
  beginning with fees imposed for the fall 2013 semester.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
