A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the student center fee at component institutions of the |
|
Texas State University System; increasing the amount of the fee. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Sections 54.523(a) and (b), Education Code, are |
|
amended to read as follows: |
|
(a) The [To the extent approved by the students under
|
|
Subsection (b) of this section, the] board of regents of the Texas |
|
State University System may charge each student enrolled in a |
|
university or other educational institution [center] under its |
|
authority a student center fee not to exceed $200 [$100] per |
|
semester or $75 [$50] per summer term of six weeks or less to be used |
|
to construct, operate, maintain, improve, and program a student |
|
center at the university or other educational institution [center] |
|
at which the student is enrolled. |
|
(b) The board may increase the amount of the student center |
|
fee authorized by this section within the limits specified by |
|
Subsection (a) but may not increase the amount by more than 10 |
|
percent from one academic year to the next unless the increase is |
|
approved by a majority vote of those students participating in a |
|
general election called for that purpose [decision to levy a
|
|
student center fee, the amount of the initial fee, and an increase
|
|
in the fee must be approved by a majority vote of those students
|
|
participating in a general election called for that purpose;
|
|
provided that this requirement shall not apply to the decision to
|
|
levy a student center fee or the amount of the initial fee approved
|
|
by the board prior to the effective date of this section]. |
|
SECTION 2. The changes in law made by this Act to Section |
|
54.523, Education Code, apply only to fees imposed for a semester or |
|
term that begins on or after the effective date of this Act. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2013. |
