A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority of the Department of Public Safety to |
|
allow blood pressure machines to be located in driver's license |
|
offices. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 411, Government Code, is amended by |
|
adding Subchapter P to read as follows: |
|
SUBCHAPTER P. AVAILABILITY OF BLOOD PRESSURE MACHINES |
|
IN DRIVER'S LICENSE OFFICES |
|
Sec. 411.441. DEFINITIONS. In this subchapter: |
|
(1) "Blood pressure machine" means a device that |
|
measures a person's blood pressure and displays the person's blood |
|
pressure reading. |
|
(2) "Driver's license" has the meaning assigned by |
|
Section 521.001, Transportation Code. |
|
Sec. 411.442. BLOOD PRESSURE MACHINE. (a) The department |
|
may allow a blood pressure machine to be located in an office |
|
authorized to issue driver's licenses in this state. |
|
(b) A blood pressure machine described by Subsection (a): |
|
(1) must be made available at no cost to the state; and |
|
(2) may not display an advertisement. |
|
(c) The department may not: |
|
(1) require an applicant for a driver's license to |
|
obtain a blood pressure reading from a blood pressure machine |
|
described by Subsection (a) as a condition of being issued a |
|
driver's license; or |
|
(2) charge a fee to obtain a blood pressure reading |
|
from a blood pressure machine described by Subsection (a). |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2013. |
