A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to certain fees charged for adjudication of claims under |
|
|
health benefit plans. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 1213.005, Insurance Code, is amended to |
|
|
read as follows: |
|
|
Sec. 1213.005. CERTAIN CHARGES PROHIBITED. A health |
|
|
benefit plan or a third-party administrator or pharmacy benefit |
|
|
manager acting on behalf of the health benefit plan may not directly |
|
|
or indirectly charge or hold a health care professional, health |
|
|
care facility, or person enrolled in a health benefit plan |
|
|
responsible for a fee for the adjudication of a claim. |
|
|
SECTION 2. This Act applies only to a claim submitted on or |
|
|
after September 1, 2013. A claim submitted before September 1, |
|
|
2013, is governed by the law as it existed immediately before that |
|
|
date, and that law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2013. |
