A BILL TO BE ENTITLED
 
AN ACT
  relating to consideration of certain open-enrollment charter
  school graduates for accountability purposes.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 39, Education Code, is
  amended by adding Section 39.0541 to read as follows:
         Sec. 39.0541.  EVALUATING OPEN-ENROLLMENT CHARTER SCHOOLS.
  For purposes of evaluating an open-enrollment charter school for
  adequate yearly progress under the No Child Left Behind Act of 2001
  (20 U.S.C. Section 6301 et seq.) and, notwithstanding Section
  39.053(c)(2), for accountability under this chapter and for
  performance under an agency performance-based monitoring analysis
  system, a student who graduates from the school is considered a high
  school graduate regardless of whether the student graduates with
  the student's ninth grade cohort.
         SECTION 2.  Section 39.0541, Education Code, as added by
  this Act, applies beginning with the 2013-2014 school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
