A BILL TO BE ENTITLED
 
AN ACT
  relating to health insurance coverage for services provided by
  chiropractic assistants.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 1451.109, Insurance Code, is amended by
  adding Subsection (e) to read as follows:
         (e)  A health insurance policy issuer may not deny payment or
  reimbursement to, or reimburse at a lower rate, a chiropractor who,
  in accordance with Section 201.451, Occupations Code, delegates to
  an assistant a task or procedure relating to the provision of a
  service by the chiropractor that is within the scope of the
  chiropractor's license, regardless of whether the chiropractor is
  physically present when the assistant performs the task or
  procedure.
         SECTION 2.  The changes in law made by this Act to Section
  1451.109, Insurance Code, apply only to a health benefit plan that
  is delivered, issued for delivery, or renewed on or after the
  effective date of this Act. A plan delivered, issued for delivery,
  or renewed before the effective date of this Act is governed by the
  law as it existed immediately before the effective date of this Act,
  and that law is continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2013.
