A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to health insurance coverage for services provided by |
|
chiropractic assistants. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 1451.109, Insurance Code, is amended by |
|
adding Subsection (e) to read as follows: |
|
(e) A health insurance policy issuer may not deny payment or |
|
reimbursement to, or reimburse at a lower rate, a chiropractor who, |
|
in accordance with Section 201.451, Occupations Code, delegates to |
|
an assistant a task or procedure relating to the provision of a |
|
service by the chiropractor that is within the scope of the |
|
chiropractor's license, regardless of whether the chiropractor is |
|
physically present when the assistant performs the task or |
|
procedure. |
|
SECTION 2. The changes in law made by this Act to Section |
|
1451.109, Insurance Code, apply only to a health benefit plan that |
|
is delivered, issued for delivery, or renewed on or after the |
|
effective date of this Act. A plan delivered, issued for delivery, |
|
or renewed before the effective date of this Act is governed by the |
|
law as it existed immediately before the effective date of this Act, |
|
and that law is continued in effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2013. |
