A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the eligibility of certain persons for appointment to a |
|
|
committee or panel that provides advice regarding the content or |
|
|
administration of assessment instruments used in public schools. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 39, Education Code, is |
|
|
amended by adding Section 39.038 to read as follows: |
|
|
Sec. 39.038. RESTRICTION ON APPOINTMENTS TO ADVISORY |
|
|
COMMITTEES. The commissioner may not appoint a person to a |
|
|
committee or panel that advises the commissioner or agency |
|
|
regarding the content or administration of an assessment instrument |
|
|
if the person is reimbursed, retained, or employed by an assessment |
|
|
instrument vendor. |
|
|
SECTION 2. If, on the effective date of this Act, a person |
|
|
is serving on a committee or panel that advises the commissioner of |
|
|
education or the Texas Education Agency who would not be eligible |
|
|
for appointment under Section 39.038, Education Code, as added by |
|
|
this Act, the person's position on the committee or panel becomes |
|
|
vacant and shall be filled in accordance with applicable law. |
|
|
SECTION 3. This Act takes effect September 1, 2013. |
