A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to restrictions on activities a poll watcher may perform |
|
|
while on duty. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 33.058(a), Election Code, is amended to |
|
|
read as follows: |
|
|
(a) While on duty, a watcher may not: |
|
|
(1) converse with an election officer regarding the |
|
|
election, except to call attention to an irregularity or violation |
|
|
of law; |
|
|
(2) converse with a voter; [or] |
|
|
(3) communicate in any manner with a voter regarding |
|
|
the election; or |
|
|
(4) use any device to produce or make an audio, visual, |
|
|
or audiovisual broadcast, recording, or photograph. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
