A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to video monitoring of an early voting polling place. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 85, Election Code, is |
|
|
amended by adding Section 85.038 to read as follows: |
|
|
Sec. 85.038. VIDEO RECORDING OF EARLY VOTING POLLING PLACE. |
|
|
(a) The early voting clerk may order video recording of the area |
|
|
within 100 feet of an outside door through which a voter may enter |
|
|
the building or structure in which an early voting polling place is |
|
|
located, except that voting stations may not be recorded. |
|
|
(b) The early voting clerk may permit a video recording made |
|
|
under Subsection (a) to be provided live on an Internet website for |
|
|
purposes of allowing the public to evaluate the wait time at an |
|
|
early voting polling place. |
|
|
(c) This section applies to any early voting polling place |
|
|
under this chapter. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
