A BILL TO BE ENTITLED
 
AN ACT
  relating to exempting certain low-income students from the payment
  of certain fees at a public institution of higher education.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 54, Education Code, is
  amended by adding Section 54.369 to read as follows:
         Sec. 54.369.  FEE EXEMPTION FOR CERTAIN LOW-INCOME STUDENTS.
  (a) Notwithstanding any other law, an institution of higher
  education shall exempt from the payment of fees authorized under
  Subchapter E any student who:
               (1)  is eligible for student financial assistance
  provided by this state; and
               (2)  has a family income that is below the federal
  poverty line.
         (b)  The Texas Higher Education Coordinating Board shall
  adopt rules for the administration of this section.
         SECTION 2.  Section 54.369, Education Code, as added by this
  Act, applies beginning with fees charged by a public institution of
  higher education for the 2014-2015 academic year.
         SECTION 3.  The Texas Higher Education Coordinating Board
  shall adopt any rules necessary under Section 54.369, Education
  Code, as added by this Act, as soon as practicable after this Act
  takes effect. For that purpose, the coordinating board may adopt
  the initial rules in the manner provided by law for emergency rules.
         SECTION 4.  This Act takes effect September 1, 2013.
