A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the definition of victim for the purpose of restitution |
|
|
liens. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 1(4), Article 42.22, Code of Criminal |
|
|
Procedure, is amended to read as follows: |
|
|
(4) "Victim" means: |
|
|
(A) a "close relative of a deceased victim," "guardian |
|
|
of a victim," or "victim," as those terms are defined by Article |
|
|
56.01 of this code; [or] |
|
|
(B) an individual who suffers damages as a result of |
|
|
another committing an offense under Section 38.04, Penal Code, in |
|
|
which the defendant used a motor vehicle while the defendant was in |
|
|
flight; or |
|
|
|
|
|
(C) an individual who suffers financial damages as a |
|
|
result of another committing a felony offense under Title 7, Penal |
|
|
Code. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a victim of a criminal offense committed on or after the |
|
|
effective date of this Act. A victim of a criminal offense |
|
|
committed before the effective date of this Act is governed by the |
|
|
law in effect on the date the offense was committed, and the former |
|
|
law is continued in effect for that purpose. For purposes of this |
|
|
section, a criminal offense was committed before the effective date |
|
|
of this Act if any element of the offense occurred before that date. |
|
|
SECTION 3. This Act takes effect September 1, 2013. |
