A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the consideration of adequate alternatives to resolve |
|
|
transmission constraints. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 39.155, Utilities Code, is amended by |
|
|
adding Subsection (e) to read as follows: |
|
|
(e) In evaluating strategies to resolve constraints |
|
|
identified in the report required by Subsection (b), the ERCOT |
|
|
independent system operator and the commission shall consider any |
|
|
proposed transmission alternatives that would enable existing or |
|
|
proposed generation resources located in this state but not |
|
|
connected to the ERCOT power region to provide power to the ERCOT |
|
|
grid. If such an alternative is proposed, the commission may not |
|
|
approve a transmission project to resolve a constraint identified |
|
|
in the report until the commission makes specific findings |
|
|
approving or rejecting the use of the proposed alternative to |
|
|
resolve the constraint. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
