A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the transfer of students of limited English proficiency |
|
from regular instructional programs to special education resource |
|
rooms. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 29, Education Code, is |
|
amended by adding Section 29.0562 to read as follows: |
|
Sec. 29.0562. TRANSFER OF STUDENTS TO SPECIAL EDUCATION |
|
RESOURCE ROOMS. A student who has been transferred out of a |
|
bilingual education or special language program to a regular |
|
all-English instructional program under Section 29.056(g) may not |
|
be transferred out of the regular all-English instructional program |
|
to a special education program resource room unless the student: |
|
(1) while in the regular all-English instructional |
|
program, has been provided intensive bilingual education or special |
|
language program instruction, as appropriate for the student, for |
|
at least 18 school weeks; and |
|
(2) has not progressed in reading, writing, speaking, |
|
or listening in English as determined using a test or assessment |
|
instrument described by Section 29.056(g). |

SECTION 2. This Act applies beginning with the 2013-2014 |
|
school year. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2013. |
