A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the procedures for the placement of children by certain |
|
governmental agencies. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 262, Family Code, is |
|
amended by adding Section 262.011 to read as follows: |
|
Sec. 262.011. POSSESSION OF CHILD BY FEDERAL AGENCY. (a) A |
|
federal governmental agency that takes possession of a child may |
|
not place the child with a person who is not the child's parent |
|
unless the child has been appointed an attorney ad litem and a |
|
guardian ad litem and a court of this state has determined that the |
|
placement is in the best interest of the child. |
|
(b) The state shall seek reimbursement from the federal |
|
governmental agency for the costs incurred by the state relating to |
|
the appointment of the attorney ad litem and guardian ad litem and |
|
the court hearing. |
|
SECTION 2. This Act takes effect September 1, 2013. |
