A BILL TO BE ENTITLED
 
AN ACT
  relating to appointment of board members and approval for
  employment for five highest-paid employees at open-enrollment
  charter schools.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 11.061(b), Education Code, is amended as
  follows:  A person may not be elected trustee of an independent
  school district and a person may not be appointed to the board of an
  open-enrollment charter school or charter school foundation unless
  the person is a qualified voter.
         SECTION 2.  Sec. 12.1059, Education Code, is amended as
  follows:  A person may not be employed by or serve as a teacher,
  librarian, educational aide, administrator, or counselor for an
  open-enrollment charter school unless the person has been approved
  by the agency following a review of the person's national criminal
  history record information as provided by Section 22.0832.  
  Further, the five highest-paid administrators shall be qualified
  voters.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
