A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the eligibility of an elected class member for a service |
|
retirement annuity. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 814.102, Government Code, is amended to |
|
read as follows: |
|
Sec. 814.102. LIMITED ELIGIBILITY OF ELECTED MEMBERS FOR |
|
SERVICE RETIREMENT. (a) Except as provided by rule adopted under |
|
Section 813.304(d) or Section 803.202(a)(2), a member who has |
|
service credit in the elected class of membership for service |
|
performed before September 1, 2013, is eligible to retire and |
|
receive a service retirement annuity if the member: |
|
(1) is at least 60 years old and has 8 years of service |
|
credit in that class; or |
|
(2) is at least 50 years old and has 12 years of |
|
service credit in that class. |
|
(b) A person who first becomes eligible to be a member of the |
|
legislature on or after September 1, 2013, is not eligible to |
|
receive an elected class service retirement annuity. |
|
SECTION 2. This Act takes effect September 1, 2013. |
