A BILL TO BE ENTITLED
 
AN ACT
  relating to the requirement to carry a certificate of number
  identification card on a vessel.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 31.028, Parks and Wildlife Code, is
  amended to read as follows:
         Sec. 31.028.  CERTIFICATE OF NUMBER. The certificate of
  number shall be pocket-size. The certificate or a facsimile of it
  [shall be carried on board the vessel at all times. It] does not
  have to be on the person of the operator if prior to trial the
  operator can produce for examination a valid certificate of number.
         SECTION 2.  Section 31.124(c), Parks and Wildlife Code, is
  amended to read as follows:
         (c)  The operator of a vessel required by this chapter to
  hold a certificate of number [aboard the vessel] shall show the
  certificate to the officer on demand.  Failure[, and failure] to
  produce the certificate [do so] constitutes a violation of this
  chapter, except that if the person charged produces to the court a
  certificate of number for the vessel that was in effect at the time
  that the violation is alleged to have occurred, the court shall
  dismiss the charge.
         SECTION 3.  Sections 31.028 and 31.124(c), Parks and
  Wildlife Code, as amended by this Act, apply only to an offense
  committed on or after the effective date of this Act.  An offense
  committed before the effective date of this Act is governed by the
  law in effect on the date the offense was committed, and the former
  law is continued in effect for that purpose.  For purposes of this
  section, an offense was committed before the effective date of this
  Act if any element of the offense occurred before that date.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
