A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the requirement to carry a certificate of number |
|
|
identification card on a vessel. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 31.028, Parks and Wildlife Code, is |
|
|
amended to read as follows: |
|
|
Sec. 31.028. CERTIFICATE OF NUMBER. The certificate of |
|
|
number shall be pocket-size. The certificate or a facsimile of it |
|
|
[shall be carried on board the vessel at all times. It] does not |
|
|
have to be on the person of the operator if prior to trial the |
|
|
operator can produce for examination a valid certificate of number. |
|
|
SECTION 2. Section 31.124(c), Parks and Wildlife Code, is |
|
|
amended to read as follows: |
|
|
(c) The operator of a vessel required by this chapter to |
|
|
hold a certificate of number [aboard the vessel] shall show the |
|
|
certificate to the officer on demand. Failure[, and failure] to |
|
|
produce the certificate [do so] constitutes a violation of this |
|
|
chapter, except that if the person charged produces to the court a |
|
|
certificate of number for the vessel that was in effect at the time |
|
|
that the violation is alleged to have occurred, the court shall |
|
|
dismiss the charge. |
|
|
SECTION 3. Sections 31.028 and 31.124(c), Parks and |
|
|
Wildlife Code, as amended by this Act, apply only to an offense |
|
|
committed on or after the effective date of this Act. An offense |
|
|
committed before the effective date of this Act is governed by the |
|
|
law in effect on the date the offense was committed, and the former |
|
|
law is continued in effect for that purpose. For purposes of this |
|
|
section, an offense was committed before the effective date of this |
|
|
Act if any element of the offense occurred before that date. |
|
|
SECTION 4. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
