A BILL TO BE ENTITLED
 
AN ACT
  relating to the powers and duties of the Legislative Budget Board,
  including the receipt of reports by the board.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 2054.102, Government Code, is amended by
  amending Subsection (a) and adding Subsections (a-1) and (a-2) to
  read as follows:
         (a)  The Legislative Budget Board may specify procedures for
  the submission, review, approval, and disapproval of biennial
  operating plans and amendments, including procedures for review or
  reconsideration of the Legislative Budget Board's disapproval of a
  biennial operating plan or biennial operating plan amendment.
         (a-1)  The Legislative Budget Board shall review and approve
  or disapprove the biennial operating plan or biennial operating
  plan amendment not later than the 60th day after the later of the:
               (1)  date of adjournment sine die of a regular
  legislative session by the second house of the legislature to
  adjourn sine die; or
               (2)  date the plan or amendment to the plan is
  submitted.
         (a-2)  The plan or amendment to the plan is considered to be
  approved on the 61st day after the later of the dates described by
  Subsection (a-1) [date the plan or amendment is submitted] if the
  Legislative Budget Board does not disapprove the plan or amendment
  before that date.
         SECTION 2.  Section 19.0041, Education Code, is amended to
  read as follows:
         Sec. 19.0041.  EVALUATION OF TRAINING SERVICES.  (a)  To
  evaluate the effectiveness of training services provided to persons
  confined or imprisoned in the department, the Windham School
  District shall [consult with the Legislative Budget Board to]
  compile and analyze information for each person who receives the
  training services.  This information shall include an evaluation
  of:
               (1)  the kind of training services provided;
               (2)  the kind of employment the person obtains on
  release;
               (3)  whether the employment was related to training;
               (4)  the difference between the amount of the person's
  earnings on the date employment is obtained following release and
  the amount of those earnings on the first anniversary of that date;
  and
               (5)  the retention factors associated with the
  employment.
         (b)  The district [Legislative Budget Board] shall submit an
  annual report to the [legislature and the] governor's office and
  the Legislative Budget Board based on data compiled and analyzed
  under Subsection (a).
         SECTION 3.  Not later than December 1, 2013, the Windham
  School District shall submit the first report to the governor's
  office and the Legislative Budget Board as required by Section
  19.0041(b), Education Code, as amended by this Act.
         SECTION 4.  Section 322.016(b), Government Code, is
  repealed.
         SECTION 5.  The changes in law made by this Act apply to a
  biennial operating plan or biennial operating plan amendment
  submitted to or pending with the Legislative Budget Board on or
  after the effective date of this Act.
         SECTION 6.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
