A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the degree to which power generation facilities consume |
|
|
or adversely impact water in this state. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 39.151, Utilities Code, is amended by |
|
|
adding Subsection (d-2) to read as follows: |
|
|
(d-2) The commission shall require an independent |
|
|
organization certified under this section to consider |
|
|
the extent to |
|
|
which facilities used to generate electricity consume or adversely |
|
|
impact water in this state. To the extent reasonably practical, the |
|
|
independent organization shall base decisions relating to dispatch |
|
|
of generation on the degree to which the facility consumes or |
|
|
adversely impacts water in this state. The commission shall |
|
|
require the independent organization to submit its findings and any |
|
|
resulting actions in the report required under Subsection (d-1)(1). |
|
|
SECTION 2. This Act takes effect September 1, 2013. |
