ating to fines for speed limit violations. |

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 545, Transportation Code, is amended by |
|
|
adding Section 545.366 to read as follows: |
|
|
Sec. 545.366. FINES FOR DRIVING OVER THE SPEED LIMIT |
|
|
(a) Notwithstanding any other law, a person may not be |
|
|
assessed a fine for driving within 10 miles per hour of the posted |
|
|
speed limit unless in the opinion of the officer, adverse weather or |
|
|
traffic conditions, or other hazardous situations constitute an |
|
|
imminent danger to the general public. (b) This section does not |
|
|
apply to violations within a school crossing zone, or within 500 |
|
|
feet of a school, institution of higher learning, or hospital, or in |
|
|
combination with another moving traffic violation. |
|
|
SECTION 2. This Act takes effect September 1, 2013. |
