A BILL TO BE ENTITLED
 
AN ACT
  relating to a study regarding the provision of the drug palivizumab
  through the Medicaid vendor drug program to premature newborns.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  The Department of State Health Services shall
  conduct a study to determine the appropriateness of criteria set
  for approval for dosage to premature newborns:
               (1)  whether a newborn should meet 3 criteria before
  administration of drug is approved;
               (2)  access to quality of medical care for a newborn
  receiving this drug;
               (3)  any other factors the Agency considers relevant.
         SECTION 2.  No later than December 1, 2014, The Texas
  Education Agency shall:
               (1)  publish the results of the study required by this
  Act on the commission's available Internet website; and
               (2)  deliver the results of the study required by this
  Act to:
                     (A)  the governor, the lieutenant governor, the
  speaker of the house of representatives, and each committee of each
  house of the legislature that has jurisdiction over state health
  services
         SECTION 3.  This Act takes effect September 1, 2013.
