A BILL TO BE ENTITLED
 
AN ACT
  relating to certain credit in the Employees Retirement System of
  Texas for service in the Texas State Guard.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter F, Chapter 813, Government Code, is
  amended by adding Section 813.510 to read as follows:
         Sec. 813.510.  CREDIT FOR ACCUMULATED TEXAS STATE GUARD
  SERVICE. (a) Except as provided by Subsection (b), a member who
  holds a position included in the employee class of membership
  during the month that includes the effective date of the member's
  retirement and who retires based on service or a disability is
  entitled to service credit in the retirement system for the
  member's hours of volunteer service in the Texas State Guard in the
  same manner as the member is credited for accumulated sick leave
  that is unused on the last day of employment.
         (b)  The board of trustees may adopt rules to implement this
  section, including rules requiring certification of any hours of
  volunteer service claimed in the Texas State Guard. In making Texas
  State Guard volunteer service creditable in the same manner as
  accumulated sick leave, the board is not required to include
  provisions that grant credit in the manner provided by Section
  813.509(d) or (e).
         SECTION 2.  Section 813.510, Government Code, as added by
  this Act, applies only to a person who retires on or after the
  effective date of this Act. A person who retires before the
  effective date of this Act is subject to the law in effect on the
  date of the person's retirement, and that law is continued in effect
  for that purpose.
         SECTION 3.  This Act takes effect September 1, 2013.
