A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the distribution by the appraisal review board of an |
|
appraisal district of written opinions, memoranda, or analyses of |
|
law drafted by the attorney for the board. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter C, Chapter 6, Tax Code, is amended by |
|
adding Section 6.44 to read as follows: |
|
Sec. 6.44. DISTRIBUTION BY BOARD OF LEGAL ANALYSES. (a) |
|
Except as provided by Subsection (b), the appraisal review board of |
|
an appraisal district may not distribute a written opinion, |
|
memorandum, or analysis of law drafted for the board by an attorney |
|
who serves as the legal counsel for the board to any person who is |
|
not a member of the board. |
|
(b) An appraisal review board may distribute a document |
|
described by Subsection (a) to a person who is not a member of the |
|
board if the board: |
|
(1) immediately makes the document available for |
|
public inspection by any person; and |
|
(2) forwards the document not later than the next |
|
business day to the comptroller to be posted on the comptroller's |
|
Internet website. |
|
(c) The comptroller shall post each document that the |
|
comptroller receives under this section on the comptroller's |
|
Internet website. |
|
SECTION 2. The change in law made by this Act applies only |
|
to a written opinion, memorandum, or analysis of law distributed on |
|
or after the effective date of this Act. A written opinion, |
|
memorandum, or analysis of law distributed before the effective |
|
date of this Act is governed by the law in effect when the document |
|
was distributed, and the former law is continued in effect for that |
|
purpose. |
|
SECTION 3. This Act takes effect September 1, 2013. |
