A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the composition of the structural pest control advisory |
|
committee. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 1951.101(a), Occupations Code, is |
|
amended to read as follows: |
|
(a) The committee consists of nine members appointed by the |
|
commissioner as follows: |
|
(1) [two members who are experts in structural pest
|
|
control application;
|
|
[(2)] three members who represent the public; |
|
(2) three members [(3)
one member from an institution
|
|
of higher education who is knowledgeable in the science of pests and
|
|
pest control;
|
|
[(4) one member] who represent [represents] the |
|
interests of structural pest control operators and who are [is] |
|
appointed based on recommendations provided by a trade association |
|
of operators; and |
|
(3) three members [(5) one member] who represent |
|
[represents] the interests of structural pest control operators and |
|
who are experienced in the area of integrated pest management |
|
programs in schools [consumers; and
|
|
[(6)
the commissioner of state health services or the
|
|
commissioner's designee]. |
|
SECTION 2. Section 1951.103(b), Occupations Code, is |
|
amended to read as follows: |
|
(b) A person may not be a member of the committee if: |
|
(1) the person is an officer, employee, or paid |
|
consultant of a Texas trade association in the field of pest control |
|
except as provided by Section 1951.101(a)(2) [1951.101(a)(4)]; or |
|
(2) the person's spouse is an officer, manager, or paid |
|
consultant of a Texas trade association in the field of pest |
|
control. |
|
SECTION 3. Section 1951.101(c), Occupations Code, is |
|
repealed. |
|
SECTION 4. The changes in law made by this Act in the |
|
qualifications of members of the structural pest control advisory |
|
committee do not affect the entitlement of a member serving on the |
|
committee immediately before the effective date of this Act to |
|
continue to serve for the remainder of the member's term. As the |
|
terms of committee members expire, the commissioner of agriculture |
|
shall appoint or reappoint a member who has the qualifications |
|
required for a member under Section 1951.101(a), Occupations Code, |
|
as amended by this Act. |
|
SECTION 5. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2013. |
