A BILL TO BE ENTITLED

|
AN ACT
|
|
|
relating to animal shelters. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 823, Section 823.001, Health & Safety |
|
|
Code, is amended to read as follows: |
|
|
Sec.823.001 DEFINITIONS. In this chapter: |
|
|
(1) "Animal shelter" means a facility that keeps or |
|
|
legally impounds stray, homeless, abandoned, or unwanted animals. |
|
|
(2) "Council" means the State Health Services Council. |
|
|
"Board" means the Texas Board of Health.
|
|
|
(3) "Commissioner" means the commissioner of health. |
|
|
(4) "Department" means the Department of State Health |
|
|
Services. |
|
|
SECTION 2. Subsection (e) of Sec.823.003, Chapter 823, |
|
|
Health and Safety Code, is amended to read as follows: |
|
|
(e) The council board may require each person operating an |
|
|
animal shelter to keep records of the date and disposition of |
|
|
animals in its custody, to maintain the records on the business |
|
|
premises of the animal shelter, and to make the records available |
|
|
for inspection at reasonable times. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
