A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to an individual's responsibilities following an accident |
|
reasonably likely to result in injury to or death of a person; |
|
imposing criminal penalties. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 550.021(a), Transportation Code, is |
|
amended to read as follows: |
|
(a) The operator of a vehicle involved in an accident that |
|
results or is reasonably likely to result [resulting] in injury to |
|
or death of a person shall: |
|
(1) immediately stop the vehicle at the scene of the |
|
accident or as close to the scene as possible; |
|
(2) immediately return to the scene of the accident if |
|
the vehicle is not stopped at the scene of the accident; [and] |
|
(3) immediately determine whether a person is involved |
|
in the accident, and if a person is involved in the accident, |
|
whether that person requires aid; and |
|
(4) remain at the scene of the accident until the |
|
operator complies with the requirements of Section 550.023. |
|
SECTION 2. The change in law made by this Act applies only |
|
to an offense committed on or after the effective date of this Act. |
|
An offense committed before the effective date of this Act is |
|
governed by the law in effect on the date the offense was committed, |
|
and the former law is continued in effect for that purpose. For |
|
purposes of this section, an offense was committed before the |
|
effective date of this Act if any element of the offense occurred |
|
before that date. |
|
SECTION 3. This Act takes effect September 1, 2013. |
