A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the intersection of a free road and a toll road. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 372, Transportation Code, is amended by |
|
|
adding Subchapter C to read as follows: |
|
|
SUBCHAPTER C. INTERSECTION OF TOLL PROJECT AND FREE ROAD |
|
|
Sec. 372.101. DEFINITION. In this subchapter, "free road" |
|
|
includes a street or public highway. |
|
|
|
|
|
Sec. 372.102. CONSTRUCTION OF TOLL PROJECT. A toll project |
|
|
entity may not construct a toll project that intersects with a free |
|
|
road unless the toll project is constructed or a traffic control |
|
|
signal is used in a manner that allows traffic on the free road to |
|
|
flow freely without yielding or stopping for toll project traffic. |
|
|
SECTION 2. This Act applies only to construction of a toll |
|
|
project, as defined by Section 372.001, Transportation Code that |
|
|
begins on or after the effective date of this Act. A toll project |
|
|
the construction of which begins before the effective date of this |
|
|
Act is governed by the law in effect on the date of the beginning of |
|
|
the construction, and the former law is continued in effect for that |
|
|
purpose. |

SECTION 3. This Act takes effect September 1, 2013. |
