A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to authorizing fees deducted from court registry funds. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 117.055(a), Local Government Code, is |
|
|
amended to read as follows: |
|
|
(a) Notwithstanding any other law, to [To] compensate the |
|
|
county for the accounting and administrative expenses incurred in |
|
|
handling all [the] registry funds that have not earned interest, |
|
|
including funds in a special or separate account and funds |
|
|
deposited under Article 17.02, Code of Criminal Procedure, the |
|
|
clerk shall, at the time of withdrawal, deduct from the amount of |
|
|
the withdrawal a fee in an amount equal to five percent of the |
|
|
withdrawal but that may not exceed $50. Withdrawal of funds |
|
|
generated from a case arising under the Family Code is exempt from |
|
|
the fee deduction provided by this section. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
