A JOINT RESOLUTION
|
|
|
proposing a constitutional amendment requiring the state to expand |
|
|
eligibility for the Medicaid program to certain persons. |
|
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article XVI, Texas Constitution, is amended by |
|
|
adding Section 74 to read as follows: |
|
|
Sec. 74. The state shall provide medical assistance under |
|
|
the federal Medicaid program to all persons who apply for that |
|
|
assistance and for whom federal matching funds are available under |
|
|
the Patient Protection and Affordable Care Act (Pub. L. No. |
|
|
111-148) as amended by the Health Care and Education Reconciliation |
|
|
Act of 2010 (Pub. L. No. 111-152) to the state to provide that |
|
|
assistance. |
|
|
SECTION 2. The following temporary provision is added to |
|
|
the Texas Constitution: |
|
|
TEMPORARY PROVISION. (a) This temporary provision applies |
|
|
to the constitutional amendment proposed by the 83rd Legislature, |
|
|
Regular Session, 2013, requiring the state to expand eligibility |
|
|
for the Medicaid program to all persons for whom federal matching |
|
|
funds are available under the federal Patient Protection and |
|
|
Affordable Care Act. |
|
|
(b) Section 74, Article XVI, of this constitution takes |
|
|
effect January 1, 2014. |
|
|
(c) This temporary provision expires January 1, 2015. |
|
|
SECTION 3. This proposed constitutional amendment shall be |
|
|
submitted to the voters at an election to be held November 5, 2013. |
|
|
The ballot shall be printed to provide for voting for or against the |
|
|
proposition: "The constitutional amendment requiring the state to |
|
|
expand eligibility for the Medicaid program to all persons for whom |
|
|
federal matching funds are available under the federal Patient |
|
|
Protection and Affordable Care Act." |
