A BILL TO BE ENTITLED
 
AN ACT
  relating to integrating behavioral health and physical health
  services provided under the Medicaid program using managed care
  organizations.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 533, Subchapter A, Government Code, is
  amended by adding Section 533.00251 to read as follows:
         Sec. 533.00251.  BEHAVIORAL HEALTH AND PHYSICAL HEALTH
  SERVICES NETWORK. (a)  The executive commissioner shall integrate
  behavioral health services, including targeted case management and
  psychiatric rehabilitation services, and physical health services
  to persons eligible for such services under the Medicaid program
  using the managed care organizations contracted to the commission
  pursuant to Chapter 533, Government Code.
         (b)  The managed care organizations contracted to the
  commission shall develop a network of providers of behavioral
  health services.
         (c)  In complying with this section, the executive
  commissioner shall ensure that:
               (1)  An appropriate assessment tool is used to
  authorize services;
               (2)  Providers are well-qualified and able to provide
  an appropriate array of services; and
               (3)  Appropriate performance and quality outcomes are
  measured.
         (d)  This section does not apply to the NorthSTAR Medicaid
  Demonstration Waiver.
         (e)  For purposes of this section, "behavioral health
  services" means mental health and substance use disorder services.
         (f)  To the extent of any conflict, this section prevails
  over any other law relating to mental and behavioral health care.
         SECTION 2.  Integration of behavioral health and physical
  health services as required by SECTION 1 must be completed by
  September 1, 2014.
         SECTION 3.  This Act takes effect September 1, 2013.
