A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the use of certain state property for community food |
|
gardens. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. (a) The General Land Office shall develop a plan |
|
for the establishment of community food gardens on real property |
|
that: |
|
(1) is owned or controlled by the state; and |
|
(2) is not being used or is being substantially |
|
underused. |
|
(b) The General Land Office shall work with other state |
|
agencies that own or control real property, including the Texas |
|
Department of Transportation, the Texas Department of Criminal |
|
Justice, and the Parks and Wildlife Department, in developing the |
|
plan. |
|
(c) The plan must: |
|
(1) identify real property owned or controlled by the |
|
state that is appropriate for the establishment of community food |
|
gardens; |
|
(2) identify any statutory or other barriers to |
|
implementation of the plan and make recommendations for eliminating |
|
or addressing those barriers; and |
|
(3) analyze the costs and benefits of implementation |
|
of the plan. |
|
(d) Not later than September 1, 2014, the General Land |
|
Office shall submit the plan to the legislature. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2013. |
