A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to access to certain stored communications of a provider |
|
|
of an electronic communications service or remote computing service |
|
|
in this state pursuant to a warrant issued in another state. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 4, Article 18.21, Code of Criminal |
|
|
Procedure, is amended by adding Subsection (g) to read as follows: |
|
|
(g) For purposes of this section, a warrant properly issued |
|
|
in another state is given full faith and credit in this state, and a |
|
|
service provider in this state that is required under the warrant to |
|
|
disclose the contents of a communication must comply with the |
|
|
warrant in accordance with the provisions of this section as if the |
|
|
warrant had been issued by a district court in this state. |
|
|
SECTION 2. This Act takes effect September 1, 2013. |
