A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the coordination of state and federal standards and |
|
reporting requirements related to the receipt of certain federal |
|
money. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 403, Government Code, is |
|
amended by adding Section 403.0123 to read as follows: |
|
Sec. 403.0123. COORDINATION OF CERTAIN STANDARDS AND |
|
REPORTING REQUIREMENTS. (a) In this section: |
|
(1) "One-time payment" means a one-time allocation of |
|
federal money, including stimulus money, to a state agency |
|
appropriated by legislation other than an annual federal |
|
appropriations act. |
|
(2) "State agency" means a department, commission, |
|
board, office, or other agency in the executive or legislative |
|
branch of state government created by the constitution or a statute |
|
of this state, including an institution of higher education as |
|
defined by Section 61.003, Education Code. |
|
(b) If at least 10 state agencies receive a combined total |
|
of at least $1 billion in one-time payments in a state fiscal year, |
|
the comptroller shall establish standards and reporting |
|
requirements, including performance benchmarks, required of each |
|
state agency that receives a one-time payment. The comptroller |
|
shall ensure that the standards and reporting requirements conform |
|
to any federal standards and reporting requirements related to the |
|
one-time payments. To the greatest extent practicable, the |
|
comptroller shall eliminate or suspend a state reporting |
|
requirement that is duplicative or unnecessary in light of the |
|
standards and reporting requirements established under this |
|
section. |

SECTION 2. This Act takes effect September 1, 2013. |
