A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to applications for certain alcoholic beverage permits and |
|
|
licenses. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 11.46, Alcoholic Beverage Code, is |
|
|
amended by adding Subsection (d) to read as follows: |
|
|
(d) The commission or administrator shall refuse to issue an |
|
|
original permit authorizing the retail sale of alcoholic beverages |
|
|
before the first anniversary of the date an original or renewal |
|
|
license or permit application filed by the same applicant for the |
|
|
same premises is refused, unless the condition that caused the |
|
|
refusal is addressed or resolved. |
|
|
SECTION 2. Section 61.42, Alcoholic Beverage Code, is |
|
|
amended by adding Subsection (d) to read as follows: |
|
|
(d) The county judge, commission, or administrator shall |
|
|
refuse to approve or issue an original license authorizing the |
|
|
retail sale of alcoholic beverages before the first anniversary of |
|
|
the date an original or renewal license or permit application filed |
|
|
by the same applicant for the same premises is refused, unless the |
|
|
condition that caused the refusal is addressed or resolved. |
|
|
SECTION 3. The changes in law made by this Act apply only |
|
|
with respect to an original or renewal alcoholic beverage permit or |
|
|
license application refused on or after the effective date of this |
|
|
Act. |

|
SECTION 4. This Act takes effect September 1, 2013. |
