A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the inclusion of natural gas as a public facility for a |
|
|
public facility corporation. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 303, Local Government |
|
|
Code, is amended by adding Section 303.007 to read as follows: |
|
|
Sec. 303.007. NATURAL GAS AS PUBLIC FACILITY. Natural gas |
|
|
purchased by a corporation for resale to a local government under an |
|
|
interlocal cooperation contract described by Section 791.025, |
|
|
Government Code, between the sponsor and the local government is |
|
|
considered a public facility for the purposes of this chapter. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
