A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to certain staff-to-child ratios applicable to |
|
|
nonresidential child-care facilities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 42.042, Human Resources Code, is amended |
|
|
by adding Subsection (m-1) to read as follows: |
|
|
(m-1) In determining the minimum standards relating to |
|
|
staff-to-child ratios applicable to nonresidential child-care |
|
|
facilities that provide care for less than 24 hours a day, the |
|
|
department may not establish a staff-to-child ratio that exceeds: |
|
|
(1) one staff member per nine children who are two |
|
|
years of age; and |
|
|
(2) one staff member per 14 children who are three |
|
|
years of age. |
|
|
SECTION 2. Not later than December 1, 2013, the executive |
|
|
commissioner of the Health and Human Services Commission shall |
|
|
adopt any rules necessary to implement Section 42.042(m-1), Human |
|
|
Resources Code, as added by this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2013. |
