A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a settlement in a contested case involving an |
|
integrated utility operating outside of ERCOT in areas of the |
|
Western Electricity Coordinating Council. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 14.054, Utilities Code, is amended by |
|
adding Subsections (c) and (d) to read as follows: |
|
(c) A settlement that resolves a contested case involving an |
|
integrated utility operating outside of ERCOT, in areas of this |
|
state that are included in the Western Electricity Coordinating |
|
Council, to which the applicant and all parties, other than the |
|
commission, have agreed, is presumed to be just, reasonable, and in |
|
the public interest, provided the agreement does not violate other |
|
provisions of law. |
|
(d) The commission staff may not take a position before the |
|
commission relating to a settlement described by Subsection (c). |
|
SECTION 2. The change in law made by this Act applies to a |
|
settlement related to a contested case reached on or after the |
|
effective date of this Act. A settlement related to a contested case |
|
reached before the effective date of this Act is governed by the law |
|
in effect immediately before that date, and that law is continued in |
|
effect for that purpose. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2013. |
