A BILL TO BE ENTITLED
 
AN ACT
  relating to the addition of certain municipalities to the territory
  of a regional transportation authority.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 452.6025(c), Transportation Code, is
  amended to read as follows:
         (c)  Notwithstanding Section 452.606, a municipality that is
  not part of an authority may be added to the territory of an
  authority on a date determined by the executive committee if:
               (1)  any part of the municipality is located in a county
  in which the authority has territory; or
               (2)  any part of the municipality is located in a county
  that is adjacent to a county in which the authority has territory,
  and by resolution adopted by the executive committee of the
  authority, the authority states its intention to provide
  transportation services to the municipality; and
               (3) [(2)]  the governing body of the municipality calls
  an election on the addition of the municipality to the territory of
  the authority and permits the voters to vote for or against the
  following proposition:
               The inclusion of the territory within the municipality
  of [insert name of municipality] as an addition to the
  territory of [insert name of the authority], pursuant
  to Section 452.6025, Transportation Code, and the
  imposition by [insert name of the authority] of a
  special sales and use tax not exceeding one percent to
  become available initially at the rate remaining after
  compliance with the municipality's existing outstanding
  contractual obligations and indebtedness reliant upon
  the special sales and use taxes specified in Section
  452.6025 and thereafter to become available to [insert
  name of the authority] as such obligations and
  indebtedness are paid, all to be accomplished in
  accordance with the terms and provisions of an
  interlocal agreement to be negotiated and executed
  between the municipality and [insert name of the
  authority].
         ;and
               (4)  [3] a majority of the votes cast in the election
  favor the proposition.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
