A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the applicability of the public information law to |
|
|
certain nongovernmental entities involved in law enforcement and |
|
|
corrections. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 552, Government Code, is |
|
|
amended by adding Section 552.0039 to read as follows: |
|
|
Sec. 552.0039. NONGOVERNMENTAL ENTITIES SUBJECT TO |
|
|
CHAPTER. A nongovernmental entity is subject to this chapter in the |
|
|
same manner as a governmental body if: |
|
|
(1) the entity's purpose is to represent individuals |
|
|
licensed under Chapter 1701, Occupations Code; and |
|
|
(2) the entity receives money from a state agency. |
|
|
SECTION 2. Subchapter F, Chapter 351, Local Government |
|
|
Code, is amended by adding Section 351.105 to read as follows: |
|
|
Sec. 351.105. INFORMATION SUBJECT TO PUBLIC INFORMATION |
|
|
LAW. A contract authorized by this subchapter between a county and |
|
|
a private organization must require that information collected, |
|
|
assembled, or maintained by the private organization operating |
|
|
under the contract be subject to Chapter 552, Government Code, to |
|
|
the extent that the information is related to a contract for the |
|
|
operation, maintenance, repair, or construction of a facility under |
|
|
this chapter. |

|
SECTION 3. This Act takes effect September 1, 2013. |
