A BILL TO BE ENTITLED
 
AN ACT
  relating to the applicability of the public information law to
  certain nongovernmental entities involved in law enforcement and
  corrections.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 552, Government Code, is
  amended by adding Section 552.0039 to read as follows:
         Sec. 552.0039.  NONGOVERNMENTAL ENTITIES SUBJECT TO
  CHAPTER. A nongovernmental entity is subject to this chapter in the
  same manner as a governmental body if:
               (1)  the entity's purpose is to represent individuals
  licensed under Chapter 1701, Occupations Code; and
               (2)  the entity receives money from a state agency.
         SECTION 2.  Subchapter F, Chapter 351, Local Government
  Code, is amended by adding Section 351.105 to read as follows:
         Sec. 351.105.  INFORMATION SUBJECT TO PUBLIC INFORMATION
  LAW. A contract authorized by this subchapter between a county and
  a private organization must require that information collected,
  assembled, or maintained by the private organization operating
  under the contract be subject to Chapter 552, Government Code, to
  the extent that the information is related to a contract for the
  operation, maintenance, repair, or construction of a facility under
  this chapter.
         SECTION 3.  This Act takes effect September 1, 2013.
