A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to the dissemination of Criminal History Record |
|
|
Information. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 552, is amended by adding Section |
|
|
552.155 to read as follows: |
|
|
Sec. 552.155. EXCEPTION: BULK DATA COMPILED THROUGH THE |
|
|
ADMINISTRATION OF CRIMINAL JUSTICE. (a) Public information that |
|
|
is produced, collected, assembled, or maintained by a governmental |
|
|
body through the administration of criminal justice is exempted |
|
|
from bulk dissemination. |
|
|
(b) In this section: |
|
|
(1) "Administration of criminal justice" has the |
|
|
meaning assigned by Article 60.01, Code of Criminal Procedure; |
|
|
(2) "Bulk dissemination" means the production by a |
|
|
governmental body of information obtained by the body through the |
|
|
administration of criminal justice that relates to offenses |
|
|
committed by 10 or more separate individuals. |
|
|
SECTION 2. EFFECTIVE DATE. This Act takes effect immediately it |
|
|
receives a vote of two-thirds of all the members elected to each |
|
|
house, as provided by Section 39, Article III, Texas Constitution. |
|
|
If this Act does not receive the vote necessary for immediate |
|
|
effect, this Act takes effect September 1, 2013. |
