A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a limitation on annexation by certain municipalities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter Z, Chapter 43, Local Government Code, |
|
|
is amended by adding Section 43.908 to read as follows: |
|
|
Sec. 43.908. RESTRICTED ANNEXATION BY CERTAIN |
|
|
MUNICIPALITIES. A municipality in a county that contains an |
|
|
international border and borders the Gulf of Mexico may not annex |
|
|
area other than an unincorporated area that is entirely surrounded |
|
|
by the incorporated territory of the municipality until all of the |
|
|
unincorporated areas that are entirely surrounded by the |
|
|
incorporated territory have been annexed. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
