A BILL TO BE ENTITLED
 
AN ACT
  relating to a study regarding the capacity and service capabilities
  of the Texas Women's Health Program.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 39, Subchapter B of the Human Resources
  Code is amended by adding Section 39.46:
         Section 39.46.  Reporting Requirement. (a) The department,
  as the agency responsible for administering the TWHP, must annually
  submit a report to the Legislature assessing the true capacity and
  service capabilities of the direct providers on its list. The
  report must contain, at a minimum, the following criteria:
         (i)  The exact number of patients each direct provider has
  the capacity to serve annually under the TWHP;
         (ii)  A formulaic analysis of how the provider and/or the
  department assessed the number of patients in Section 39.46(a)(i);
         (iii)  The number of patients each direct provider served in
  the previous fiscal year under the TWHP;
         (iv)  The number of physicians for each direct provider that
  perform services under the TWHP;
         (v)  A description of the services that each direct provider
  has the capability to provide under the TWHP; and
         (vi)  A description of the services that each direct provider
  does not have the capability to provide under the TWHP.
         (b)  The department, as the agency responsible for
  administering the TWHP, must submit the report under Section
  39.46(a) to the Legislature as soon as practically possible, but no
  later than January 31st of each legislative session.
         SECTION 2.  This Act takes effect September 1, 2013.
