SENATE JOINT RESOLUTION
  proposing a constitutional amendment establishing a transportation
  infrastructure fund to assist counties in this state in the
  construction, reconstruction, or maintenance of transportation
  infrastructure that is intended to alleviate degradation caused by
  the exploration, development, or production of oil or gas.
         BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Article III, Texas Constitution, is amended by
  adding Section 49-q to read as follows:
         Sec. 49-q.  (a)  The transportation infrastructure fund is
  established as a special fund in the state treasury.
         (b)  In each fiscal year, the comptroller of public accounts
  shall transfer from the economic stabilization fund to the
  transportation infrastructure fund three percent of the amount
  transferred in that fiscal year under Subsection (c) of Section
  49-g of this article.
         (c)  The transportation infrastructure fund may be used only
  for the purpose of assisting counties in this state in the
  construction, reconstruction, or maintenance of transportation
  infrastructure that is intended to alleviate degradation caused by
  the exploration, development, or production of oil or gas.
         SECTION 2.  Section 49-g, Article III, Texas Constitution,
  is amended by adding Subsection (j-1) to read as follows:
         (j-1)  In each fiscal year, the comptroller shall transfer to
  the transportation infrastructure fund three percent of the amount
  transferred to the economic stabilization fund under Subsection (c)
  of this section.
         SECTION 3.  This proposed constitutional amendment shall be
  submitted to the voters at an election to be held November 5, 2013.
  The ballot shall be printed to permit voting for or against the
  proposition: "The constitutional amendment establishing a
  transportation infrastructure fund to assist counties in this state
  in the construction, reconstruction, or maintenance of
  transportation infrastructure that is intended to alleviate
  degradation caused by the exploration, development, or production
  of oil or gas."
