LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

April 17, 2013

TO:
Honorable Lois W. Kolkhorst, Chair, House Committee on Public Health

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB46 by Flynn (Relating to the regulation of raw milk and raw milk products.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend Health and Safety Code Chapter 435, related to the regulation of raw milk and raw milk products. The bill would authorize a person who holds a permit to sell raw milk or raw milk products to sell the products at the permit holder's place of business, the consumer's residence, or a farmer's market. Based on revised analysis provided by the Department of State Health Services, it is assumed the number of new entities seeking licensure would not be high enough to result in an increased FTE need at DSHS. It is assumed DSHS can absorb the cost of implementation of the bill within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
